If it's reported as lost/stolen most likely Sprint will flag/ban the ESN. Therefore you won't be able to activate it.

'Tis the season to do the right thing...call Sprint and let them know what's happening. This will generate positive karma for you and you will reap the rewards.

Just call and let them know what happened. You might get lucky and be able to activate the phone if it isn't claimed in a certain amount of time. This will kill 2 birds with one stone.

1. Finding out if he called the phone in as lost or stolen
2. You knowing you did the right thing and you might have a touch pro

If no calls you back and Sprint can't give you the info to get back to the rightful owner (would be against policy I would think) would be a good guinea pig to test rom's or customizations :mrgreen:

This is also a very good idea...i would like to have a touch pro but would also want to kill myself if i ever bricked one i purchased! \\:D/
