what's the latest version opera on the imagio and is there a newer version ready to download. and can someone post a cab or link

The latest version on the Imagio is 9.5. The latest release from Opera (which Timmy linked to) is Opera 10. There are a few 9.7 builds for download over at XDA Forums.

I know for sure Opera 10 is beta.
Some of the 9.7 builds from XDA said "beta" other don't. I'm not sure if those are final...

9.7 is technically still beta too, but the later builds are pretty stable and work well. 10 is a new beta and still has quite a few non-working functions and stability I hear isn't too great just yet, but the interface seems nice.

Opera 9 was the last final build. I haven't had any stability issues with Opera 10 Beta.

Opera 10's working great for me. Had one glitch where it said my phone was out of memory, but it's fine otherwise.
