I remember something like this a few years ago. Some scammer was selling a picture of the phone. The buyer got the picture and then sued the scammer for false advertising. The buyer won the lawsuit only because the scammer had listed the generic specs for the phone, which included the weight of the device. Since the photo obviously didn't weigh as much as the real thing, it was ruled that the item was misrepresented.

I really can never understand why someone would buy a touchy complicated electronic device from ebay (or craigslist). Maybe if it was 10 cents on the dollar. I hear story after story about people getting screwed, and you have zero warranty or protection in most cases.

this been goin on for years of ppl r dumb enough not to read its not the sellers fault. although eBay consider it scam imo its fully legal he's selling a fully described box and the rest if ppl don't read its not his fault and he can ask any price he wishes for as long as he didn't violate the eula I don't think his post should have been removed
