I can't believe this worked, but my wife, who as a 1250 minute $49 SERO plan (and only should have had the $30 plan/450 Minute plan, she never goes as high as 300 minutes) was 8 months or so out-of-contract, unlike me. This is because she stayed with her Mogul when I went to the TP2. In another thread, a member or two had ran up to a certain point on BestBuy.com, but hadn't "pulled the trigger" for one reason or another. That was this morning. I immediately tried, but the site was going into overload mode, and I never could get it completed to see if it worked. It took until now to get it to get me back into CheckOut, despite the phone being in my (well, HER) cart all day (and we never got "timed out"). I had already entered the Credit Card and Drivers License this AM (twice), but kept crashing out. Just now, it went all the way through, after entering it again. The pages have drop down boxes that say "Keep Existing Plan", and I saved each of the 2 pages that said that in 4 different formats with the dropdown boxes open, and printed the final Thank You page 3 times, in case there is a fight when we go to activate it.

I don't think they can win. In the worst case, we have a $449 phone for $251 (including S&H and the tax on the full price), and a good cause of legal action (against both Best Buy and Sprint) for refusing to activate it. Oh, and we did have the $10 fee added to the "Keep Existing Plan". No biggie.

You'd better hurry if you're eligible, this loophole probably will get closed soon.

I think the more important consideration is that they'll probably change your plan once they audit accounts, especially your Evo-Sero combination that stands out like an albino black sheep LOL. But good luck and congrats on getting an Evo!!

like i said in the other thread, someone on the back end will probably catch it before it ships, give you a call and let you change plans or cancel

Isnt gonna happen I had a similar thing with my Hero and they wouldnt activate the phone unless I changed my plan. So I was able to order the phone and have it shipped but once I had the phone I couldnt activate it. So untill you have it and its activated you have not succeeded.

I realize there are potential flies in the ointment, and posting this could be one too, but I think there is a strong element of a contract here, and feel I should give others the chance to grab the deal too.

It's possible. I just looked online at her Chase credit card, and that amount is already in the Pending Charges. I think it will be easier to push a few buttons to make it happen than come to the middle of nowhere and fight a lawsuit. Maybe I'm wrong somehow, but I think we got them this time.

And I am telling you THEY WILL NOT ACTIVATE IT. Anyway pm me when they wont activate it ok?

I received my phone on my old plan.. They charged my card too... I could not activate it.... Retentions couldnt even help... GOOD LUCK!

True, maybe they'll offer some compensating discounts for the length of the contract, and then be able to be free of it (unless she run out-of-contract again)

My wife is happy enough with her Mogul to not cave in, and will enlist me to help fight this tooth and nail, especially if the phone is in hand through normal channels, charged to her credit card, and with the wording "Keep Existing Plan", and they won't activate it (if not under SERO, at least for the same price). This would be a breach of contract. I'm pretty sure we'd win.

Are you guys not forgetting that if they won't activate it, we have an Evo for $251, can change the credit card number as soon as the phone ships, and if they won't activate it, we have a $449 phone for $199 and tax

From what I understand they wont be able to activate it even if they wanted to..the reps won't have the ability and will endlessly say ...sorry nothing we can do about it...

im pretty sure thats illegal and would borderline be considered stealing and breach of contract in itself. because they give you the phone at a "discount" assuming that you are either signing or renewing contract with them. they can charge it to your account and even if you change the card number they still have the original on file and possibly force it through. worst case scenario they do have your cell number along with address and can still send you a bill. if you refuse to pay it might get sent to collection and be a bigger hassle then its worth.

this dude is out there.They do not have to do anything.I do not care how you got it.It can't be activated and i would be first in line if you could to do it also but it can't happen.The system will not allow it.

Even if the rep wanted to.And as far as a suit you are really out there if you think you got a case at all.

what happens if you try to activate online? my brother has sero and got the samsung google phone. our friend owns a sprint store and said he could hook it up... needless to say when the phone came, he wasn't able to hook it up and he owns the sprint store :) all he could do was give my brother a $10 off. a month and change the plan.

You're missing the point. We try to activate it, Sprint refuses. Best Buy sold it to us for $199 with a new contract, and Sprint won't fulfill the deal. We are certainly not signing a new 2 year contract on the Mogul, when we can just stay on month-to-month.

A plan with discounts to match the Best Buy deal, even if it ends after 2 years, would be acceptable. One thing they can't do with my wife is think she'll cave in because she "just has to have this phone". That's one of the benefits of getting older.

Ok..sprint will say best buy is a reseller so deal with them (best case give you 25$ for your inconvenience)

Best Buy will find some terms of service on their site that allows them to cancel any order where there is a mistake in the system.

Plus I think contract only starts when you activate your phone >.>

I have a suit if they won't activate, and then try to charge full price. We will NOT be the ones who aren't trying to activate it, if anything, it will be them refusing. There certainly is a contract with Best Buy here. They may have an issue with Sprint, but they'll resolve that easily. But they won't get the phone back, nor be able to charge full price, if they, and/or who they represent fail to fulfill the deal. And as I said in another post, we'll drop the "SERO" as long as the price matches, even if it ends after the 2 year period (which SERO wouldn't). How does that sound for fairness and compromise?

While I do see what you're saying im about 99% sure you wont be able to get it activated on that plan. If you can, congrats youre the effin man. Typing this on muh evo and this is the first time the keyboard has felt semi laggy. i should probably kill some of the many apps I have open.

And that will work, as long as we match the $59 price ($49 + $10 Evo data fee). It doesn't have to be called Sero, and in 2 years, the world may well be a place we barely recognize anyway.

Oh I get your point. And yes when they won't activate it keep and sell the phone for sure. But the screw ups here are all the sites selling the EVO online. When I bought mine on Sprint.com I actually used one of my other business lines upgrade (it is a 30 bucks a month plan) and it let me go through the motions and then a pop up that says "In order to activate this you will need to change your current plan to one of the following or compatible" (not verbatim) and it lists all the plans. Sprint has thrown it out there that you need to have certain plans plenty of times. So I think you would have a case against Best Buy because they were not forth coming in what you would need to use your purchase. It isn't really a loop hole... It is them assuming that people know what they need to have to purchase the phone ( stupid assumption). I only know The word Sero because I am on all the forums but I have no idea what the plans are... Does she have unlimited data?

As long as we try to activate, and are reasonable in accepting a plan that matches the price, though not a SERO account, we are going above and beyond what was agreed to. We would even agree to pay $69, and they turn on the HotSpot for the extra $10, which she would only use if the cable wireless was out, and at a point where she wanted to watch NetFlix through the Roku box, which works GREAT on the Evo in 3G. But that would be a rare happening.

And if Best Buy cancels the order, not much we can do. This is all based on once it ships, and we recieve it.

I tend to agree, we'll probably have to call the plan by another name, and have off-setting credits. But once it's shipped, she will be activated somehow for $59 a month ($49 + $10), or perhaps a little more if they through in the HotSpot. I'm not going to be unreasonable, but we also don't have "got-to-have-it-itis". Especially my wife. She loves the Evo, but could be happy with a flip phone. The amount technology contributes to her happiness in life is less than 1/10th of 1%. I usually can't even reach her by cell, she silences it for some reason and forgets it for days.

so let me get this straight... if sprint doesnt let you keep the sero with the evo youll "settle" for a new plan of comparable price and value? wouldnt that kind of defeat the purpose of them making some of us change plans? at that rate they may as well let you keep your sero. then again this IS all hypothetical until you get the phone.

Yes, unlimited data, texts, etc. The 3 plans differ only in minutes of talk time, excluding nights and weekends, etc., like any other plan. The $30 plan has 450 minutes, the $49 plan has 1250 minutes, and the $99 plan has 2500 minutes, which is not even a good deal anymore compared to the regular $99 Everything Plan.

I think the only case I would have against Best Buy would be in the following scenarios: Upon Sprint refusing to activate, Best Buy tried, or succeeded in charging us full price. Or they did a collection/lawsuit kind of thing. If they just wanted the phone back, and we refused, and they went away, I don't really see the issue, UNLESS the phone was "marked" so that it couldn't be activated, including if we sold it. THEN they would be up the creek, as I see it.

Not really, because it puts an end to the SERO account, and the matching of the price, 2 years from now at the latest. If we "camp on our SERO", and keep using qualified phones (even if she keeps finding old Moguls or other qualified phones for 20 years, or keeps using TEP to replace failed/broken/lost phones), I think they are stuck with leaving her plan alone indefinitely. That is how SERO works. That is why they want to get people off of it so bad. It's like Rent Control lol

No not on SERO. On a Business 200 plan ( basically just 200 minutes). And yes without the 10.00 fee... But like I said it told we I would have to have one of a few plans or compatible. To me compatible would be unlimited data, text, etc and the 10.00 Premium... So There is an argument there. Playing the Devil's Advocate as always though Sprint was pretty upfront about what you would need to have for this phone. Either way... Definitely good luck to you.

Sprint has been vague and contradictory in press releases (evidence the Dan Hesse issue), and who says anyone needs to have any info channel from Sprint? Did this just come from Sprint through the media? Did they ever call or email me about the EVO? NO, they never did. And how can I be expected to have a better info channel from Sprint than Best Buy? Best Buy made me answer a bunch of things, including my wifes SS#, DRIVERS LICENSE # and Expiration (I guess you need to be able to drive to get it, though you can't drive and talk on it, except on Bluetooth), and you are claiming that with that need for personal data, AND their ability to check it all in 90 seconds (can YOU do that?), they don't know what they are doing? Well, I guess there is a price for ignorance.

Not true..if you don't drive you can get a "None Drivers License" which pretty much is a drivers license but doesn't give you license to drive...aka simply an ID card...

Most e-commerce sites have disclaimers on the site stating something like they can refuse to honor a price for various reasons. And in the US, there really ain't chit you can do about legally ( and win).

IF their site let you do it, they don't have to activate, and no amount of screen shots will change that fact.

Hold on... I never once said Best buy didn't know what they were doing. I said earlier that the third parties essentially screwed up by not flashing the same screen that Sprint does when you purchase the phone with an incompatible plan therefore that is who the problem should be with on that
end. Next.. I was basically saying that you have a valid argument because it seems to me that the sero plans are very cheap plans that offer unlimited data etc so the only reason Sprint has not to activate is because they don't want to. Not sure what you read in my post to elicit that response. Were you calling me ignorant?

Yeah, I know. I've been licensed since age 14, as I grew up in South Dakota. By the time I hit 16, I had driven in 33 states, and most major cities in the country. In those days, there was full recoginition of other states licensing policies, and they were respected everywhere. Now, here in CA for instance, they repect licenses that meet their minimum standards for their own citizens. This is a big issue with Concealed Carry Permits now too. I have permits good in 30+ states, but not everywhere. You have to know a ton of individual state laws. It's stupid. Bring back the good old days..........

I think TheBundo is a tool. I'm all for getting a good deal etc, but you, my friend, are an informed consumer looking for a loophole to pull one over on Sprint. You, and others like you, are the reasons why the rest of us regular customers have a hard with even modest requests of customer service.

And I'm not some little pansy, if you knew who I am, you might bite your tongue. IF their site let you do it, they don't have to activate, and no amount of screen shots will change that fact.

I doubt that means I have to give the phone back
