i'm watching just to see what happens lol! i'm just wondering how they have a phone that's not out yet, and brand new at that! when i got my tp from telesales early, i went to the sprint store and because i got it earlier than they did, they couldn't provision it. imagine someone bringing that in and the reps can't activate it 'til the official release!

Q: Do you have pics of the actual item? Where and how did you get this unreleased phone if it is really a clean ESN that can be activated?
A: I do not yet have this item in hand but will for sure by the end of the month. Sorry but I cannot reveal my source.

everyone report him just for a good laugh he sounds like a jerk going by all the questions answered and i am starting to think some kind of scam mainly because of his answers to the questions.

I am not positive but I am pretty damn sure that Ebay has a rule that you must have physical possession of any item that you are holding an auction for...

If that was true they wouldnt let people sell things that arnt real like donations or the people that just sell info...

No, I do not think that you can sell something that you do not have when you list it. What youa re talking about are intangible things and that is different.

Nah, thats not the case unless they made some changes recently. When the ps3 came out 4 years ago me and my best friend had sold several before it was released, so yeah we didnt have any in our possesion at the time of the sale. At the time they had certain stipulations as far as your feeedback score etc... when it came to pre selling anything.

they cant sue ya nothing would ever be exchange they will just file an unpaid dispute you get a mark and he re-ebays it for no charge. but I smell a scam anyway watch him send a picture of the phone to ya

eBay certainly can, read your fine print. Every bid is a binding contract. They might not do much for $100 but its different when you get up to $2000.

It is a binding contract but I don't think you can sue. Like what ajac said all you can do is file an unpaid dispute and resell it or you can do a second chance offer and sell to who ever came in second place. Thats why when it comes to some higher end merchandise you can set up certain stipulations like having the bidders pre-screened or have them pay a deposit and if they win the deposit becomes non-refundable if they refuse to pay for the item and who ever bidded but didn't win would just get back their deposit. Thats a good way to weed out the posers.

EDIT: If it was the other way around where someone paid $2000 but didn't recieve the merchandise then things would be different, but if I say that I will pay for it and then don't then there isn't much ebay can do.

as a future attorney - yes it is a k, but let's say you materially breach (don't pay) and seller indeed sues the party for not following through on his/her promise to pay, plaintiff must show actual damages in ct - a ct will almost never grant specific performance 9i.e. make you go forward with the deal/pay for the product). the damages would not be anything, they will be very hard to prove, could just get refund for filing, and maybe get the difference from what the seller sold to the breaching party less the amount of subsequent sale.
So, yes you could file, but it would be more of a frivolous/waste-of-time suit. Hope this helps
