Just remember, if sprint gives you the run around you can always go back to HTC for them to warranty the device

SUCCESS. Called Tech support Tier 2 and was on hold then got disconnected so called Regular tech support up and chose the phone does not work option. Took 5 minutes getting warranty exchange NIB on the way 3 business days. Thanks guys so much for all the help. Might actually delve into custom roms when i get the new one.
