Wow this is a really sticky situation. I hope it works out well for you.

Whenever I buy a phone on Craigslist I always make the seller allow me to open the box call Sprint *2 and read the esn behind the battery to the rep and ask them to verify that it can be activated on my account. Only once has it been bad and the guy trying to sell it me acted all surprised.
