Since when has it been illegal to gain access to your OS/system files? To my knowledge it's frowned upon by those trying to deny you access to your system, mostly and basically because most people would end up messing up their system (phone in this case) if they don't know what they are doing and then they would not be able to assist you in fixing it afterwards, nor would they be held responsible. So you end up doing so at your own risk.

It's like cracking open your car's engine popping in a DIY turbo following some tutorial, online guide or youtube video, then when it doesn't work, you call the manufacturer for help.. They respond with.. Um sorry you're on your own.

EDIT: Jailbreaking is a totally different monster altogether. It does hold some legal discrepancies since it is partially circumventing protection implemented in keeping the device for use on the intended carrier, other than just allowing file access and installation of non-Apple or AT&T approved apps/uses... they do it more to protect their investment into the device then to deny you control over your device.

as mentioned before jailbreaking isn't illegal as far as city/state/federal law goes.... it was illegal in the eyes, for example, Apple
now Apple cannot say it is against their license for you to jailbreak their phone because Federal law now dictates that jailbreaking a phone is no longer a legal defense for Apple to void users warranties

at least that's the way I see it...

on a side note, I don't like when people use jailbreak as a generalized term for rooting, I think jailbreak should only be used to refer to rooting an iPhone or Apple product... let's use rooting as the generic term... again just my personal thought
