Sprint Says No to Activate with no Data Plan

I have a HTC Mogul that I want to use. I called Sprint to activate and they tell me I have to have a Data plan to use the Mogul.. Ive called a few times and they told me this a few times..

Anyone have any ideas..? I will only use the Wifi..

Try activating online, with your current plan (if you have one)

Is it a new activation? You could just do an online swap if you have a line already set up.

Just call and do an ESN change without telling them what kind of phone it is. Say it's a Sprint branded phone and therefore will activate right.

If you buy the device from them them (new) then yes you do. If you bring your own device you do not have to have a data plan. VZW tries this crap also.

Start the contract with a data plan, and then see if they will let you cancel it.

Wrong. Get a different rep who knows what they are doing instead of trying to make a commission.

you don't need to purchase a data plan to activate any phone no matter what it is
their new reps are all about making money off commission and will try to force you to buy things you don't need and then get pissed at you when you refuse

Like I said, if you bought the device from them and is new with a new activation then yes you have to get the Data Plan. However, if it a device you got 2nd hand from someone like my or anyone else here on the board or ebay or craigslist or where ever, you are bringing your own device and therefore do not have to have the Data Plan.
