has nothing to do with the rom, rather the ESN.
technically speaking their supposed to allow the swap, but nobody's legally challenged any of the refusal of carriers yet.

You should be fine regardless as long as you can get Sprint to activate your eSN. The 2 phones are identical hardware wise I believe (unlike the VZN phone which has lower specs) so you shouldn't have to worry about custom configuring ROM's due to lower specs.

In other word you should be able to activate it, but they won't do it because the ESN is not theirs, therefore forcing you to buy the phone from their company so they can make even more profit.

im not sprint, but I've had no trouble activating other companies phones on Alltel. just tell them that it's your replacement HTC Touch Pro or something, and if they ask tell them it's a Sprint one. Generally for non-blackberry's most companies dont give up too much a fight on determining if the phone is really theirs.

Thanks for all the good info. I dont really want to take the risk and get denied of service b/c I dropped some cash on a phone that was "branded" for a different service provider.

i am currently facing a VERY similar dilemma. i was an Alltel subscriber but decided to switch to Sprint. I was told it wouldn't be a problem since Sprint carries the SAME exact phone and they are both CDMA unlike the Fuze on AT&T. but wen i tryd to have it activated the DEC # (aka ESN) failed....so while speaking to the guy in tech support this is wat he told me and i quote, "Well sir, to put it quite simply for you to understand, it is impossible to use the same phone with diff carriers." you, me, and everybody else who is gonna read this knows that this is BS. long story short Sprint refused to even try any other alternatives and told me to re-buy the touch pro. i kno there has to be a way to get the TP activated.
