I would call HTC tomorrow and explain to them the problems...Try and sweet talk em and they might be willing to send you out a replacement. I find sweet talking Verizon works 90% of the time and I get what I want..hehe

I have nothing sweet to say to PCD or HTC right now.i have sprint tech support on the phone with me as we speak and its looking promising. they feel my pain and processing an order to send a new one out

How did that happen? Anytime I was told to call HTC, HTC would tell me that Sprint covers the warranty on the phones, and that they won't have anything to do with it. I've even had them on conference calls as Sprint would tell me to call HTC, and HTC would tell me they can't do anything.
In any case, I tell Sprint that the phone is still under the 1 year warranty, and as long as the problem is something that can't be resolved by a hard reset (e.g. due to physical issue, such as speaker, screen, and not something fixed by software), they'll usually drop one in the mail. I just got a brand new one last week since my first one started to have issues with the earpiece. I do have insurance, but only for lost/physical, and pay $4 for that (not $7 for full coverage). I say that when the phone is about to go out of warranty, it's time for a new one...

i called 800-229-1235 and they transfered me to the warranty department. the girl at sprint said that they are having some defective issues with the TP and other phones so there would be no charge for sending the new one out
