New TP2 phone, but activated in someone else account

I try to activate my new TP2 that I bought on ebay today.

I tried many times to activate on the web but no go.

Then I call Sprint to ask them to do it for me and he said the phone is under someone else account after I read him the ESN.

He said to tell the owner to remove it first, then I can call back to do it again.

Have you all heard of this?

This ebay seller got 65 positive feedback and no negative and another buyer bought from him a TP2 also and he has no problem.

Yes, he has not yet replied. I mean this just happened few hrs ago when I did this activation.

If activated in someone else account, Sprint can release the ESN after the owner call in and I can get it to work?

Yea just wait for them to release it. The good thing about ebay is if you paid with paypal you should be able to get your money back if they are trying scam you. With that rating he won't get the fund until you leave a positive feedback anyway.

I know. And I pay with my credit card too. I am not too worried about it. I just want to get my new phone going.

I just have never heard of a new phone unopened and activated in someone else account. I guess the seller could have got the phone at the store and the Reps key or scan in the ESN from the side of the box.

I been playing the phone thru my home WIFI. So far so good. TP2 is big.

its happened to me at least twice when i got new phones from asurion. i couldn't activate them because they were under someone elses account even though they were brand new phones.
