Be persistent and ask for a manager. Don't necessary ask for a free upgrade but demand a better condition phone.

unfortunately, the refurb depot is currently working on the condition of the phones coming out. its not just the moguls, but all types of them. i work at a sprint service center...so i know. unfortunately, most of the service centers do not stock replacement phones (seed stock) instore, so the only thing they can do is order another one. you will have to go to a corporate sprint location with a service center, which are very rare....customer service will not know which ones are corporate for some reason
i myself had to order 4 moguls within a month: 1st keyboard didnt work 2nd lcd didnt work 3rd hinge was messed up 4th didnt turn on or activate i held onto the moguls i ordered, took them all apart, and created 1 good phone |

Probably didn't cost him anything, do you know how many phones the service centers DON't send back to advanced exchange?
