Mogul import banned?
 
Don't know if you guys have seen this yet:

This seems to affect all new EVDO phones, so the question is whether or not the Mogul made it in under the wire to be grandfathered in.

Can anyone confirm that sprint can still import the Mogul into the US?

The International Trade Commission has ordered a partial ban on new CDMA/W-CDMA cellular phones sold in the US that use Qualcomm processors.

While current models are not affected and will continue to be sold, any new models that have been recently announced such as the HTC Mogul on Sprint or the Samsung A727 on AT&T will not be released.

Qualcomm recently lost a lawsuit brought on by Broadcom when a judge found that Qualcomm violated three Broadcomm patents implemented in Qualcomm processors. Until the case is settled no new CDMA/W-CDMA models that utilize Qualcomm processors will be released severely affecting business plans for CDMA carriers (Sprint, Verizon, Alltel, etc.) while AT&T will only launch new models that do not use Qualcomm processors such as those from Nokia. We will cover this development and post as soon as new information is available

well gsm is gonna be hurt also, only thing that they might have better in the us atleast is the 8525

The Mogul is in a grey area with respect to this ban. It is possible that it will fall under the exemption which allows models that have been "imported for sale to the general public" prior to June 7th to continue to be imported and sold. I think if Sprint has a warehouse full of Moguls that were about to go on sale that they will have a case to let importation go on....OTOH, if they dont bring the handsets into the US until closer to the sale date, then they will have a problem.

FWIW, there are still all kinds of possibilities for this ban....there could be a presidential veto, a court could issue a stay, the companies could settle or there could be a work around developed (though testing could take a while). Only time will tell...
