what carrier do you have? i know if you buy the phone ourright you can just add it to your plan and they wont really bother you that its a smart phone. you just have to add unlimited data on the plan wich for me is 20 bucvks. (with sms/mms included also) or you can use a dumb phone to your account and then switch to a smart phone and they wont really bother you. mind you i know THIS WORKS for alltel users. i have no idea about any other carriers.

I know a dude with a Touch on vzw who doesn't have a data plan. Also can't you get a SERO plan for sprint without data and still have a smartphone?

I know with gsm carriers all you need to do is buy an unlocked phone and put your sim card in it. Maybe you find some way to convince them to transfer your number with your current plan.
