Help UTStarcom ppc 6700 Altell keeps freezing

We just got this phone last week and have searched the net for an answer and so far nothing comes close to answering this problem. Time is of the essence as we have a couple of days to return the phone if not happy with it, so far it seems ok although, When it's plugged into the cradle it just shuts down and the only way to turn it back on is to do a soft reset. This just happened on battery too! I saw that there is a rom update available from UT but the link is dead so when you go to register to download they only make software updates available to clients who have service contracts with them, WTF? I saw Helmis mobile 6, but we don't want to take a chance in turning the phone into a brick. Also when not plugged in it sometimes goes to sleep and tapping the screen doesn't bring it back only pushing down the power button brings it back. I have followed the instructions on what others have done like removing programs but no good. Could this be a hardware failure? I don' t want to do a hard reset if I don' have to but if that is the only way to find out then I will.
