I'm not sure if it's fake or not, but HTC does technically have rights to issue such a cease and desist. These ROMs are not for Android devices only so the open source argument is unfortunately moot. Also, even on the Android devices, there is proprietary software included on them, such as HTC Sense. Also, I'm pretty sure when the letter refers to "artwork" it may be referring to the sample photos and wallpapers that they include on a lot of their shipped devices.

Edit: Either way, I'm rooting for conflipper... he's helped out a lot of people in this community...

If I am unable to put custom roms on my HTC devices I will no longer but buying HTC devices.

Who is Htc to complain?They ship out all their phones with poor performance and its up to us to make them usable by fixing their mess. ASK Evo owners about the flaws on their Evos. You'll get your head rip ped off.

2 things to remember however,
1. they did not go after him for hacking and modding, in fact HTC admits to deliberately taking a

hands off approach about the modder / ROM chef community

which is nice to hear them actually admit
2. they only asked him to stop distributing their shipped roms as they feel that is intentional IP infringement

so yes, step in the wrong direction but not the end of everything

Instead of tryin to stop the "rom" makers they need to fire the current staff, get on these forums and start handing them job applications lol
