In my opinion, in a dark environment (movies, bed, at night while at a stop light, ...) 40% is unnecessarily bright. In a bright environment (outside during the day in Texas and Florida) 40% is practically useless, as a matter of fact, 100% is not as visible as I would like, but it is what it is.

At the end of the day this is a convenient feature that in many cases will save battery power.
